Our company includes different brands. When you visit, shop, create an account with us, or use our websites and applications, your information is controlled by Eden Brothers, LLC and its affiliates (“Company,” “we,” or “us”). We respect your privacy and are committed to protecting it through our compliance with this Privacy Policy (this “Policy”). Please read this Policy carefully to understand our policies and practices for collecting, using, maintaining, protecting, and disclosing your information.  If you do not agree with our policies and practices, your choice is not visit, register with, access, use, or otherwise engage (collectively, “interact”) with us or our Websites, Events, Social Media or Affiliate program (each as defined below). By interacting with this website or otherwise contacting us, you agree to this Policy.

This Policy describes the types of information we may collect from you or that you may provide when you:

  • Interact with the websites at edenbrothers.mom, www.bulkseedstore.com, www.bulkwildflowers.com, and/or www.flowerbulbfarm.com (collectively, our “Websites”).
  • Inquire about or participate in events we conduct, including contests and sweepstakes (each an “Event” and collectively, our “Events”).
  • Email, text, call, or otherwise communicate with us, including through our Social Media pages (your “Communications”).
  • Interact with our pages or accounts on social media platforms (our “Social Media”), including when you view or click on posts or links, such as those related to our Events.
  • Interact with text messages or e-mail messages you receive from us.
  • Apply for and engage in our Eden Brothers Affiliate Program (the “Affiliate Program”).
  • Interact with us in other online or offline contexts where we are the party that determines the purposes and means of processing your Personal Information (as defined below).

Our Websites, together with the content, products, and services we provide, are collectively referred to herein as our “Services.”

If you are an applicant for full- or part-time employment or an independent contractor position with us, submitting information to us through the Job Opportunities (or similar) page on our Website or otherwise, this Policy does not apply to you. Instead, please refer to our Job Applicant Privacy Notice for more information.

This Policy does not apply to information collected by any third party (other than our own service providers acting on our behalf), including through any application, website, or content offered by such third parties (e.g., Social Media pages or platforms) that may link to or be accessible from or on our Websites. See the Section below titled Third-Party Sites and Services for more information. 

This Policy may change from time to time (see Changes to Our Privacy Policy).  Your continued use of our Websites after we make changes is deemed to be acceptance of those changes, so please check this Policy periodically for updates.

Children Under the Age of 18

Our Services are not for children.  No one under 18 is permitted to provide any information to us or our service providers, whether on our Websites, Social Media or otherwise.  We do not knowingly collect information from children.  If you are under 18, do not use our Websites or provide any information. Users Outside of the United States

Our Website is hosted in the United States and our Services are provided from the United States. It is possible that certain information will be stored on servers in multiple other countries on the “cloud” or other similar distributed hosting platforms. If you are accessing our Website or otherwise interacting with us from Canada, the United Kingdom, the European Union, Asia, or any other jurisdiction with laws governing personal data collection, use, and disclosure that differ from United States laws, please note that by using our Website or otherwise interacting with us and providing your Personal Information to us, you are expressly and knowingly consenting to the transfer of your Personal Information from your home country to the United States and other jurisdictions as indicated above (where laws may differ from the laws of your jurisdiction), and you are expressly and knowingly consenting to our use of such Personal Information in accordance with this Policy.

Information We Collect & How We Collect It

We collect two basic types of information:

  • Information that identifies (whether directly or indirectly) a particular individual, such as your name, postal address, email address, and telephone number, or that is maintained in personally-identifiable form (collectively, “Personal Information”); and
  • Information that does not directly or indirectly identify, and cannot reasonably be used to identify, an individual and that is not otherwise maintained in personally-identifiable form (collectively, “Anonymous Information”). When Anonymous Information is directly or indirectly associated with Personal Information, the resulting information is also treated as Personal Information.

We may use Personal Information and Anonymous Information to create a third type of information: information about groups or categories of individuals, which does not identify and cannot reasonably be used to identify an individual (“Aggregate Information”).

In particular, we (or our third-party service providers acting on our behalf) may collect:

  • Contact information you provide, such as when you request information, sign-up for our newsletter, create an account, participate in an Event, apply for our Affiliate Program, or otherwise contact us (including through our Social Media). This may include your name, email address, telephone number, social media account handles, and address of residency.
  • Transaction information you provide when you request information, contact us, or purchase, return, request, or exchange a product or service from us, such as your postal address and telephone number, as well as commercial information related to your purchase and use of our Services, such as a history of your product purchases.
  • Payment information such as your credit card or debit card information, security codes, zip codes (for verification purposes), and other financial account information used to process transactions related to our Services. Please note that this information is collected and processed solely by our third-party payment processor on our behalf and not by us directly.
  • Information you voluntarily upload on our Websites or on our Social Media, such as your product reviews, photos, contest submissions, and comments (your “User Uploads”).  If you provide Personal Information in your User Uploads, that Personal Information may be publicly posted and otherwise disclosed without limitation as to its use by us or by a third party.
  • Location information, including your zip code (optional) during sign-up and your address at the time of purchase. While we track IP addresses, they are not a reliable source of location information. Primarily, we use self-reported zip codes to determine USDA growing zones, allowing us to provide relevant content and regional product suggestions.
  • Activity, usage, viewing, technical, and device data when you visit our Websites, or interact with emails or text messages we send. This includes the content you view, how often you use our Websites, your browser or device type, unique device identifier, IP address, browsing history, search history and other information on your interaction with our Websites or Social Media or on your interaction with advertisements on our Website or on Social Media or other websites.  We may obtain this information from a third party, such as a site or platform provider.
  • Inference information, which may include inferences drawn from the information described above that we use to create a profile about you reflecting your preferences, patterns, and behavior.
  • Copies of your Communications, including call recordings when you call our customer service lines.
  • Any other information (including Personal Information) you choose to provide in any forms, messages or other Communications submitted by you to us, including through our Website or Social Media or using the contact information provided on our Website or Social Media.

Sensitive Personal Information

Except for payment card information used by you to purchase our Services (which, as previously noted, is collected and processed solely by our third-party payment processor on our behalf and not by us directly), generally we do not knowingly collect or process personally-identifiable information that falls within the definition of “sensitive personal information” or similar terms or concepts used under applicable data privacy laws (collectively, “Sensitive Personal Information”). However, if we do collect any such Sensitive Personal Information, we will use such information on a limited basis only (i) as necessary to perform services or provide products reasonably expected by an average person who requests those products or services from us; (ii) for purposes of helping to ensure security and integrity to the extent the use of such Sensitive Personal Information is reasonably necessary and proportionate for these purposes; (iii) as a service provider to another business performing services on behalf of that business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business; (iv) for purposes of undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us; or (v) as otherwise permitted by applicable law and regulations.

How We Collect Your Information

We may collect information from you in the following ways:

  • Directly From You.  We collect information you provide to us when you request or purchase products, services, or information from us, register with us, submit or post User Uploads, respond to surveys, call our customer service phone number(s), or otherwise interact with us.  
  • Through Automatic Technologies.  We collect information through a variety of technologies, such as cookies, pixels, tags, software development kits, application program interfaces, and Web beacons, including when you visit our Websites, whether or not you are logged in or registered.  Please see Automatic Technologies We Use for further information and Your Controls and Choices for information about how to disable cookies or otherwise make choices with respect to such data collection.
  • From Social Media. When you engage with our Social Media, we may collect information such as your social media handle and public profile information. Interactions on our posts do not provide us access to your email address, real name, browsing history, or preferences.

Automatic Technologies We Use

The technologies we use to automatically collect your information when you interact with our Websites include:

  • Cookies (or browser cookies).  A cookie is a small file placed on the hard drive of your computer.  Cookies may collect data such as your IP address, browser type, operating system, referring URLs, access times, and your activity on our Websites, including the pages you visit and the links you click. You may refuse to accept browser cookies by activating the appropriate setting on your browser.  However, if you select this setting, you may be unable to access certain parts of our Websites.  Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites.
  • Click Tracking.  Click tracking is an analytical feature that measures and reports where users click or tap on our Websites.  Every time you click on our Websites, we record the event and log your user session for future analysis.  We use this information to improve our Services, for merchandising purposes, and for better targeting and personalizing our (and our service providers’) content, advertisements and marketing communications to you.  Click tracking only collects the IP address assigned to you on the date when you visit our Websites, which we may combine and store with other Personal Information we have about you.
  • Analytics.  We collect analytics information from third-party service providers, such as Google, Microsoft, and Klaviyo, through server-side tracking.  This includes information about your interaction(s) with our Websites and advertising campaigns.  This includes what pages you visit and when, what sites you visited prior to coming to our Websites, and your IP address.  We use the customer engagement information we get from analytics tools to improve our Services, for merchandising purposes, and for better targeting and personalizing our (or our service providers’) content, advertisements and marketing communications to you, and may combine the information collected this way with other Personal Information we may have about you.
  • Business Intelligence and Lead Generation Tools.  We use business intelligence tools, such as Klaviyo, Google Analytics, Triple Whale, and Microsoft Power BI, to identify and analyze your visits to our Websites and your engagement with our advertising campaigns, through server-side tracking.  These tools collect data about your interactions with us, your visits to our Websites, your engagement with our emails, and the performance of our advertising campaigns.  This information helps us understand your behavior and preferences and allows us to tailor our marketing strategies.  We also use Performance Horizon Inc trading as Partnerize, who provides us with Ascend by Partnerize (“Partnerize”) for our Affiliate Program, to track and manage affiliate marketing activities, including clicks, conversions, and purchase history.  The data collected is used to optimize our marketing efforts, improve your engagement, and drive business growth.  We use the information we get from these tools only to improve our Services and do not combine the information collected with other Personal Information we may have about you.
  • E-Commerce Platforms.  We use e-commerce platforms, such as Shopify, to manage our online store and facilitate transactions through server-side tracking.  These platforms collect data such as your purchase history, product preferences, and browsing behavior on our Websites.  This information helps us understand your purchasing patterns and preferences and allows us to improve our product offerings and customer support, and also allows us to better target and personalize our (and our service providers’) content, advertisements and marketing communications to you.  The data collected is used to streamline your shopping experience, manage inventory, and enhance your overall satisfaction.  We may combine the information collected with other Personal Information we may have about you.

We use various third-party tracking tools in connection with our Website, including but not limited to the following:

  • Klaviyo. Klaviyo tracks users’ on-site behavior and ties it back to a detailed user profile that includes purchase history, browsing activity, click patterns, and communication interactions. This comprehensive data collection allows us to build targeted and personalized marketing communications based on customers’ preferences, behaviors, and actions. By understanding how users interact with our Website, we can send more relevant emails, tailor our marketing campaigns, and improve the overall customer experience. We also use Klaviyo's insights to segment our audience and deliver content that aligns with their interests.
  • Partnerize. Partnerize uses tracking codes and tags on our Websites to collect data about your interactions, such as clicks, conversions, and purchase history.  These tracking technologies help us understand the performance of our Affiliate Program.  The data collected by Partnerize is used to attribute sales or leads to the correct publishers and optimize our marketing efforts.

How We Use Your Information

In General

Consistent with applicable law and choices and controls that may be available to you, we may use information collected from you, or from devices associated with you to:

  • Present our Websites and their contents to you.
  • Provide you with the experiences, products, and services you request, view, engage with, or purchase, including fulfilling any product orders you may place through the Website or otherwise.
  • Process payments through the Website, including providing for the collection and processing of your payment card information on our behalf by our third-party payment processors(s), payment gateways and merchant service providers.
  • Communicate with you about your account or transactions with us and send you information or request feedback about features on our Websites and or changes to our policies.
  • Provide you with support and respond to your inquiries and customer support requests relating to our Services or our Website, including to investigate and address your concerns and to monitor and improve our responses.
  • Authenticate or otherwise verify your identity in connection with your requests and inquiries via the Website or otherwise.
  • Update and maintain customer, subscription, e-mail, or mailing lists (such as our lists to receive promotional messages, newsletters, or alerts by e-mail or text message).
  • Send you offers and promotions for our products and services.
  • Facilitate your participation in sweepstakes, contexts or giveaways.
  • Develop and administer voluntary user surveys.
  • Personalize your content and experiences, including by recognizing you when you return to our Websites and storing information about your preferences.

  • With respect to aggregated and de-identified information, fulfill the purposes described in the section below titled Use and Disclosure of Aggregated or De-Identified Data.
  • Operate, understand, optimize, develop, or improve our Services and operations including our Affiliate Program.
  • Detect, investigate, and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal.
  • Notify you of product recalls or safety issues.
  • Notify you about changes to our Website, our Services or this Policy.
  • Respond to lawful requests for information through court orders, subpoenas, warrants, and other legal processes or obligations.
  • Enforce any contracts between you and us, including for billing and collection, or for the establishment, exercise, or defense of legal claims.
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information (including Personal Information) held by us is among the assets transferred.
  • Fulfill the purpose for which you provided the information, or any other purpose described at the time of collection, or for another purpose with your consent.

Use and Disclosure of Aggregated or De-Identified Data

We may convert or combine some Personal Information of Website users or other individuals with whom we interact under this Policy into de-identified or aggregated data that does not disclose any of the Personal Information of any individual. We may use and disclose to third parties (and such third parties may in turn use and disclose) any such de-identified or aggregated data (including but not limited to traffic and usage data that does not identify you personally) for any lawful purpose.

Notice of Financial Incentives

In certain situations, we may offer you favorable pricing or service differences in exchange for your supply of Personal Information (each, a “Financial Incentive”). The material terms applicable to each Financial Incentive (i.e., the Personal Information you must provide to participate in the Financial Incentive and the benefits you will receive by participating) will be set forth on the page of our Website or other location or communication where the Financial Incentive is displayed. You may “opt-in” to a particular Financial Incentive by providing the requested Personal Information. In accordance with the CCPA and the laws of other U.S. states, where applicable, you may withdraw from a Financial Incentive and direct us to stop using your information in the manner contemplated by the Financial Incentive at any time by e-mailing us at service@edenbrothers.mom. The pricing or service difference we offer in connection with each Financial Incentive will be reasonably related to the value of the Personal Information you provide, as determined by our good faith estimate taking into account one or more of the following: (1) the marginal or average value to our business associated with the collection of your Personal Information; (2) the aggregate value to our business associated with the collection of each consumer’s Personal Information divided by the total number of consumers who provide their Personal Information to us; or (3) any other practical and reasonably reliable method for determining the value of your Personal Information.

Use of Google Analytics

We may use Google Analytics to track and analyze certain traffic and usage statistics regarding the use of our Website, such as the number of visitors to our Website, how visitors are navigating to our Website, visitors’ general geographic region information, how long individuals are visiting our Website, and information about the equipment individuals are using to access our Website (e.g., browser version and operating system). Google Analytics may use a Google Analytics cookie as part of this service, and we may share certain Personal Information with Google Analytics as part of this service. We use this traffic and usage information to gauge, internally, the effectiveness of our advertising efforts and to make improvements to our Website and our marketing and promotional efforts.

In addition, we may use the following Google Analytics Advertising Features:

  • Remarketing
  • Google Display Network Impression Reporting
  • Google Analytics Demographics and Interest Reporting
  • Google Ads (as an integrated service with Google Analytics)
  • Google Search Ads 360

By enabling these features, we and certain third-party vendors may use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together for various purposes. The information collected may include demographic information about our Website visitors and general information about our visitors’ interests. We may use the information collected through our use of the Google Analytics Advertising Features to track our Website visitors’ patterns and behaviors, segment our audience, and to better target our advertising and marketing efforts (for our own and others’ products and services) and allow third-party vendors to do the same, for example to (1) display targeted advertisements to individuals who viewed a product or service but did not purchase the product or service, (2) target visitors from a certain geographic region with certain ads in Google search results that have previously shown a high degree of success for consumers in that region, (3) advertise our products and services across other websites that you may visit, or (4) allow Google or other third-party vendors to show you ads on websites that you visit after using our Website or clicking on an offer or ad in one of our e-mails or on our Website.

You can opt out of our use of certain Google Analytics features by updating the “Ads Settings” in your browser (www.adssettings.google.com/authenticated) or mobile device (www.support.google.com/ads/answer/1660762#mob), by enabling the Google Analytics Opt-out Browser Add-on in your browser (https://tools.google.com/dlpage/gaoptout), or by visiting the Network Advertising Initiative’s Consumer Opt-Out page (optout.networkadvertising.org). Informational and Marketing Text Message Program

When you use the Website and include your mobile telephone number at registration or check out, or when you initiate an SMS text message communication with us using a number we have provided for this purpose, you will be given an option to participate in our SMS text message program (the “Text Message Program”). We provide the Text Message Program to send you (1) informational and transactional communications relating to your use of the Website, such as status updates about Orders placed and Order fulfilment (“Informational Texts”), and (2) Marketing, advertising and promotional communications, such as special offers, discounts or promotions relating to the Website or our products and services (“Marketing Texts”). You will be given the option to receive either or both of our Informational Texts and/or Marketing Texts. By subscribing to the Text Message Program, you voluntarily authorize and direct us to send text messages (including either or both of our Informational Texts and Marketing Texts, depending on the settings you have selected) using an automated system to the mobile telephone number you have provided. You are not required to use or subscribe to the Text Message Program as a condition of using the Website, in order to benefit from other Website features that are unrelated to the Text Message Program, or as a condition to completing any purchase on our Website or otherwise. We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. Additionally, please be advised that the Website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart, and this information may be used by us or our service providers to determine when to send cart reminder messages via SMS.

Once enrolled in the Text Message Program, you may opt out of the Text Message Program (i.e., stop text messages) at any time. With respect to any text message, you may reply STOP, at which time we will reply by text to give you the option to stop Informational Texts, stop Marketing Texts or stop all text messages (and after which we will stop sending the specified messages). You may also opt out by contacting us at service@edenbrothers.mom. If you contact us by e-mail please include “Text Message Opt Out” or similar language in the subject line of your e-mail, to assist us in our efforts to ensure prompt and proper processing of your e-mail request. Regardless of the method you use to opt out, please allow us a few days to process your opt out request.

How We Disclose Your Information

Generally

We may disclose your Personal Information to third parties in the following circumstances:

  • We may disclose Personal Information to our affiliates or to any contractors and other service providers who need to know such information (or such contractors, service providers, or other third parties may collect Personal Information directly from you on our behalf) to provide services to us that support the operation of our business, the hosting, maintenance, operation, and promotion of our Website, and our other permitted uses of Personal Information under this Policy. For example, we may disclose the following types of information to the following service providers for the purposes described below:.
    • We may disclose contact information to our email marketing services provider to manage newsletter sign-ups and email communications, our order management system to fulfill orders, payment processors to securely process payments, and Shopify to facilitate purchases, manage customer accounts, and provide customer support. This information may also be used by analytics and business intelligence platforms to generate customer insights and visualizations.
    • We may disclose transaction information to our payment processors to process your purchases on Shopify, to our other service providers to facilitate purchases, manage customer accounts, process transaction information, track and manage inventory, generate sales reports and analytics, create data visualizations and business intelligence reports, ensure compliance with legal and financial regulations, and provide customer support, and to our order management system to track and manage order fulfillment and generate analytics and data visualization reports.
    • Payment information is collected and processed directly by our payment processors to process and facilitate your purchases. As previously noted, we do not store or process this information directly; our third-party payment processors exclusively handle this information on our behalf.
    • User Uploads with review management platforms to display reviews, customer service platforms to handle inquiries, and marketing platforms to showcase testimonials and photos, enhancing our product offerings and customer experience. User-generated content may also be analyzed and visualized to improve customer engagement strategies.
    • Location information, namely IP address and zip code with our email marketing services provider to provide relevant content and regional product suggestions based on your location. Location data may also be visualized to assess geographic trends and regional performance.
    • Activity, usage, viewing, technical, and device data with our analytics companies and email marketing services provider to understand how you interact with our emails and Websites, our web hosting provider to ensure the proper functioning of our Websites, our e-commerce platform provider to process transactions and manage your shopping experience, Partnerize to track and attribute sales in our Affiliate Program, and with our transaction processors to securely handle payments. These data types may be further processed by analytics and business intelligence platforms to generate visual reports and usage insights.  Additionally, site activity data is shared with Meta/Facebook for retargeting purposes if you are simultaneously logged into both Facebook and one of our Websites via your browser.
  • When we provide you with relevant advertising on third-party Websites and applications, we may share limited Personal Information about you such as certain identifiers or hashed email address, with third parties.   • We may disclose Personal Information to our affiliates or to a buyer or other successor to our business in the event of a sale of equity or assets, reorganization, merger, divestiture, or a similar corporate transaction, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, and any due diligence review with respect to any such proposed transaction.
  • We may also disclose Personal Information to enforce or apply any legal agreements between us and you, such as our Terms of Use; to ensure the safety and security of our users, customers, employees, and/or other third parties; to protect our rights and property and the rights and property of our users, customers, employees, and/or other third parties; to comply with any court order or legal process or in other cases if we believe in good faith that disclosure is required by law (including to meet national security and law enforcement requirements or to respond to any government or regulatory request or audit); for any purpose disclosed when the information was provided; and for any other purpose with your consent.

No Sales of Personal Information

We do not sell, and in the past 12 months we have not sold, any Personal Information to third parties.

Third-Party Sites and Services

Our Website and electronic messages to you may include links to blogs, social media, and third-party websites. These third-party sites have their own privacy policies and terms of use which are not controlled by this Policy. You should carefully review any terms, conditions, and policies of such third-party sites before visiting them or supplying them with any Personal Information.  If you follow a link from our Website or electronic messages to any third-party site, any information you provide to that site will be governed by its own terms of use and privacy policy.

We are not responsible for the privacy or security of any information you provide to a third-party website or the information practices used by any third-party site, including those that are accessed via links from our Website or electronic messages. We make no representations, express or implied, concerning the accuracy, privacy, safety, security, or the information practices of any third-party site.  The inclusion of a link to a third-party site on our Website or in our electronic messages does not constitute any type of endorsement of the linked site by us. We are not responsible for any loss or damage you may sustain resulting from your use of any third-party website or any information you share with a third-party website.

Your Controls and Choices

Generally

You have certain choices regarding the Personal Information you provide to us.

You can set your browser to refuse certain cookies, or you may be provided with a means to reject our use of certain cookies through the Website. If you choose not to accept certain cookies, you may be unable to access certain parts or pages of our Website, or certain parts or features of our Website may not function properly.

Accessing, Correcting and Deleting Your Information: Generally

You can review, change, and/or request the deletion of certain portions of your Personal Information collected or processed by us under this Policy in accordance with the laws of certain U.S. states (such as the California Consumer Privacy Act of 2018 (as amended to date, the “CCPA”)), as applicable, and the following:

Regardless of the method you use to contact us, please indicate in your communication that you are making a Request to Know, Request to Correct, or a Request to Delete (as applicable) under the Eden Brothers Privacy Policy.
  • Upon receipt of your Request to Know, Request to Correct, or Request to Delete, as part of our security measures and as required by law, we will take steps to verify your identity in order to confirm that the person making the request is actually the person about whom we have collected Personal Information (i.e., that the “you” making the request is actually you). We will verify your identity and confirm your request by asking you to confirm and verify certain Personal Information we already have on file for you. For example, if you have purchased a product through our Website or if you have registered for an account on our Website, we may verify your request by asking you to (1) send an e-mail to service@edenbrothers.mom using the e-mail address we have on file for your account, and (2) in that e-mail, verify at least one other item of Personal Information we have on file for your account. We will provide our specific request at the time we provide an initial response to your Request to Know, Request to Correct, or Request to Delete.
  • We will use reasonable endeavors to accommodate verifiable Requests to Know, Requests to Correct, and Requests to Delete submitted in the manner described above within a reasonable timeframe after receiving such requests. In any event, we will comply with your Request to Know, Request to Correct, and Request to Delete to the extent and in the manner required by applicable law, but we may deny a request, in whole or in part, to the extent an exception applies under (or as otherwise permitted by) applicable law, including the CCPA. For example, we cannot and will not comply with a Request to Know, Request to Correct, or a Request to Delete if we cannot reasonably verify your identity in connection with your request.
  • You may also designate an authorized agent to make a Request to Know, Request to Correct, or Request to Delete on your behalf. To designate an authorized agent to act on your behalf, you or your authorized agent must submit proof that either (1) such agent has actually been authorized in writing to act on your behalf, or (2) you have provided the authorized agent with power of attorney under the applicable laws in your jurisdiction. You may submit such proof by e-mailing us at service@edenbrothers.mom. If a duly-designated authorized agent makes a Request to Know, Request to Correct, or Request to Delete on your behalf, we will still require you to verify your own identity using the process described above, unless an exception applies under applicable law in your jurisdiction (for example, you have submitted verifiable proof to us that you have provided the authorized agent with power of attorney).

No Differential Treatment

If you choose to exercise any of the rights described in the Section above titled Accessing, Correcting, and Deleting Your Information: Generally, you will not receive differential treatment by us as a result (e.g., different prices or quality of products or services), except to the extent permitted by applicable law—including if those differences are reasonably related to the value of your Personal Information, as discussed above in the Section titled Notice of Financial Incentives.

California “Shine The Light” Disclosure

The California Civil Code permits California residents with whom we have an established business relationship to request that we provide a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the preceding calendar year. To make such a request, please send an e-mail to service@edenbrothers.mom or otherwise contact us using the information set forth below. Please mention that you are making a “California Shine the Light” inquiry. Please note, however, that we do not without your separate consent currently disclose any Personal Information to third parties for their direct marketing purposes.

Nevada Residents: Sale Opt-Out Rights

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: service@edenbrothers.mom. Please mention that you are making a “Nevada Sale Opt-Out Right” request. However, please know that we do not currently sell data triggering that statute's opt-out requirements.

Online Tracking Technologies and Advertising

We, including through advertising, marketing, or audience measurement service providers, operating on our behalf, may collect information about your activity, or activity on devices associated with you, on our Websites using tracking technologies such as cookies, pixels, tags, software development kits, application program interfaces, and Web beacons.
